Interpretation

Words with capitalized initial letters have the meanings defined below, whether used in the singular or plural.

Definitions

Affiliate

An entity that controls, is controlled by, or is under common control with a party. Control means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for directors or other managing authority.

Terms and Conditions / Terms

These Terms and Conditions, which form the entire agreement between You and the Company regarding use of the Service.

Third-party Social Media Service

Services or content, including data, information, products or services, provided by a third party and displayed, included or made available through the Service.

You

The individual accessing or using the Service, or the company or other legal entity on whose behalf that individual accesses or uses the Service.

These Terms govern use of the Service and set out the rights and obligations of all visitors, users and others who access or use it.

Your access to and use of the Service is conditional on Your acceptance of and compliance with these Terms. By accessing or using the Service, You agree to be bound by them. If You disagree with any part, You may not access the Service.

You represent that You are over 18 years of age. The Company does not permit those under 18 to use the Service.

Your use of the Service is also conditional on acceptance of and compliance with the Company's Privacy Policy, which explains the collection, use and disclosure of personal information, Your privacy rights and applicable protections. Please read the Privacy Policy before using the Service.

The Company has no control over and assumes no responsibility for their content, privacy policies or practices. You acknowledge that the Company shall not be responsible or liable, directly or indirectly, for damage or loss caused or alleged to be caused by the use of or reliance on content, goods or services available through those websites or services.

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including if You breach these Terms.

Upon termination, Your right to use the Service will cease immediately.

Notwithstanding any damages You might incur, the entire liability of the Company and its suppliers under these Terms, and Your exclusive remedy, shall be limited to the amount actually paid by You through the Service, or USD 100 if You have not purchased anything through the Service.

To the maximum extent permitted by applicable law, the Company and its suppliers shall not be liable for special, incidental, indirect or consequential damages, including loss of profits, data or other information, business interruption, personal injury or loss of privacy arising from or related to use of or inability to use the Service, third-party software or hardware used with the Service, or any provision of these Terms, even if advised of the possibility of such damages and even if a remedy fails of its essential purpose.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages. In those jurisdictions, each party's liability shall be limited to the greatest extent permitted by law.

The Service is provided “AS IS” and “AS AVAILABLE”, with all faults and defects and without warranty of any kind. To the maximum extent permitted by applicable law, the Company, on its own behalf and on behalf of its Affiliates, licensors and service providers, disclaims all express, implied, statutory or other warranties, including merchantability, fitness for a particular purpose, title, non-infringement and warranties arising from course of dealing, performance, usage or trade practice.

The Company makes no warranty that the Service will meet Your requirements, achieve intended results, be compatible with other software, applications, systems or services, operate without interruption, meet performance or reliability standards, be error-free, or that errors or defects can or will be corrected.

Neither the Company nor its providers warrants the operation or availability of the Service or its information, content, materials or products; uninterrupted or error-free service; accuracy, reliability or currency of information; or that the Service, servers, content or emails are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Where a jurisdiction does not allow exclusion of certain warranties or limitation of statutory consumer rights, these exclusions and limitations apply only to the greatest extent enforceable under applicable law.

The laws of India, excluding conflict-of-law rules, govern these Terms and Your use of the Service. Your use may also be subject to other applicable local, state, national or international laws.

If You have a concern or dispute about the Service, You agree to first try to resolve it informally by contacting the Company.

If You are a European Union consumer, You benefit from any mandatory provisions of the law of the country in which You reside.

You represent and warrant that You are not located in a country subject to a United States government embargo or designated by that government as a “terrorist supporting” country, and that You are not listed on a United States government list of prohibited or restricted parties.

Severability

If a provision is held unenforceable or invalid, it shall be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law. The remaining provisions continue in full force and effect.

Waiver

Except as provided in these Terms, failure to exercise a right or require performance of an obligation does not affect a party's ability to do so later. Waiver of a breach does not waive a subsequent breach.

These Terms may be made available in translation. You agree that the original English text shall prevail in the event of a dispute.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. For a material revision, We will make reasonable efforts to provide at least 30 days' notice before new terms take effect. What constitutes a material change is determined at Our sole discretion.

By continuing to access or use the Service after revisions take effect, You agree to be bound by the revised Terms. If You do not agree, in whole or in part, please stop using the Website and Service.
